Understanding Bali’s zoning—ranging from Green to Orange zones—was crucial to avoid legal troubles and secure our investment.
The Importance of Zoning, Ownership, and Leasehold in Bali
An essential aspect of our journey was grasping the intricate details of Bali’s zoning laws. Each zone has its own rules regarding what can and cannot be constructed, and failing to adhere to these can lead to severe legal and financial repercussions. Building in the wrong zone could result in hefty fines or even demolition orders, underscoring the necessity of checking zoning certificates and consulting legal experts before any property commitments.
Land Ownership 101: The Not-So-Secret Rules
For foreigners, understanding land ownership in Bali is not straightforward. Freehold ownership is reserved for locals, while foreigners can lease land long-term, akin to a super-extended Airbnb stay. Setting up a PT PMA (a foreign investment company) offers another route to property ownership. However, leasehold properties, the most common path for foreigners, present challenges like uncertainties over lease renewal and potential disputes over land rights. Negotiating extension options upfront is crucial to safeguarding your investment and ensuring its long-term viability.
Working with the Agency
Teaming up with a Dutch agency specializing in overseas property purchases marked a significant turning point. Their promise to help us narrow down our options, guide us through legal procedures, and organise an assistant in Bali was invaluable. After eight months of independent searching and an additional three months with the agency, we finally shortlisted six properties to visit in person. This collaboration was pivotal in navigating the complexities of land and law, offering the local connections and insights necessary to make informed decisions. From there, it was another year until the construction work was fully completed, but the confidence in our choices was bolstered by the agency's expertise.
By integrating these lessons, we were better equipped to handle the intricacies of Bali's property landscape, ensuring that our investment was secure and legally sound.
